Parties and Scope

These Terms of Service ("Terms") constitute a binding agreement between FinaryLabs ("Company", "we", "us", "our") and the individual ("User", "you") who downloads, installs, accesses, or otherwise uses the HUSH mobile application ("Application").

These Terms take effect upon any use of the Application. If you do not agree to these Terms, you must immediately cease using the Application.

HUSH is available exclusively on iOS and Android mobile platforms. No official service is provided via desktop, web browser, or any other platform.

Description of Service

HUSH is a mobile application offering end-to-end encrypted, zero-log, identity-free voice and video calling services.

1. Service Features
   • One-on-one voice calls
   • One-on-one video calls
   • Group voice and video calls (subject to plan limits)
   • Meeting code-based call joining
   • Contact management (HUSH ID-based)
2. Intentionally Excluded Features The following features are deliberately absent from HUSH:
   • Instant messaging (chat)
   • File sharing
   • Call recording
   • Screen recording (blocked at system level)
   • Call history and call logs
3. Free Plan Upon first installation, users are granted limited free usage rights. Once these rights are exhausted or the trial period expires, a paid subscription is required. Free plan rights are personal, non-transferable, and may not be used for commercial purposes.

Account Creation and Identity

1. Identity-Free Registration Creating a HUSH account requires only a username and password. We do not request your real name, phone number, email address, or any other identifying information.
2. Sign in with Apple / Google Users may sign in using Apple ID or Google account. When this method is chosen, we only verify that the account belongs to a real device; no email address, name, or other data is transferred to or stored in our systems. Apple's "Hide My Email" feature is fully supported.
3. Account Security You are solely responsible for the security of your account. Do not share your password with anyone. If you suspect unauthorized access, change your password immediately. The Company assumes no liability for damages arising from password loss or compromise.
4. Single Account Policy Each user is entitled to one free plan benefit. Creating multiple accounts to abuse free usage rights constitutes a violation of these Terms and may result in suspension of all associated accounts.

Subscription and Payment Terms

2. Payment Method All payments are processed exclusively through Apple Pay or Google Pay. No credit card details, IBAN, or other payment data is stored in our systems. Transactions are processed via Apple App Store or Google Play Store infrastructure, subject to those platforms' own privacy policies.
3. Automatic Renewal Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. The renewal charge is collected within 24 hours prior to the end of the current period. Cancellation must be performed through App Store or Google Play settings.
4. Free Trial A 7-day free trial is available for the Plus plan. If not cancelled before the trial ends, billing will commence automatically. Each user is eligible for only one free trial.
5. Refund Policy Refunds for subscription services are governed by Apple App Store or Google Play Store refund policies. FinaryLabs does not offer independent refund commitments beyond those platform policies.

Permitted Use and Restrictions

2. Prohibited Uses — Zero Tolerance for Objectionable Content and Abusive Users

   STRICTLY PROHIBITED

   HUSH enforces a zero-tolerance policy for objectionable content and abusive users in any user-generated content. The following uses constitute explicit violations of these Terms and will result in immediate account termination:

   • Producing or transmitting objectionable, obscene, hateful, discriminatory, or demeaning content (including usernames, profile images, and call content)
   • Harassment, bullying, threats, blackmail, or any other abusive behavior toward other users
   • Planning or executing any criminal activity
   • Terrorism, drug trafficking, or organized crime
   • Child exploitation content or violations of laws protecting minors
   • Attempting to reverse engineer, decompile, or copy the application
   • Security testing or penetration attempts (without prior written consent)
   • Creating multiple accounts to abuse free plan rights
   • Denial-of-service attacks or overload attempts on the infrastructure
3. Reporting, Blocking, and Content Moderation

   Users may at any time use the in-app "Report User" and "Block User" mechanisms when they encounter objectionable content or abusive behavior. A blocked user is instantly removed from the blocking user's feed (including contacts, call lists, and the ability to invite the blocking user).

   FinaryLabs commits to reviewing reported content and accounts within 24 hours, and, upon verification of a violation, to removing the content and ejecting the offending account from the application. Due to end-to-end encryption, no call content provided by users is retained on our servers; reports are evaluated at the account level.

Intellectual Property

The HUSH application, brand, logo, interface design, and all technical architecture are the exclusive property of FinaryLabs and are protected under applicable intellectual property laws.

The rights granted to the User are limited to a personal, non-transferable license to use the application. This license does not include the right to copy, distribute, create derivative works, or use the application for commercial purposes.

Limitation of Liability

1. Service Continuity FinaryLabs does not guarantee that the service will operate without interruption or error. The service may be temporarily unavailable due to maintenance, updates, or technical failures.
2. Disclaimer To the maximum extent permitted by applicable law, FinaryLabs shall not be liable for any indirect, incidental, special, or punitive damages arising from the use or inability to use the service.
3. User Content While HUSH neither records nor stores call content, all legal responsibility for the substance of communications between users rests exclusively with the parties involved in those communications.

Modifications and Termination

FinaryLabs reserves the right to modify plans, pricing, and features with prior notice. Material changes will be communicated via in-app notification or publication of updated Terms.

In the event of a violation of these Terms, FinaryLabs reserves the right to suspend or permanently delete an account without prior notice. Upon account deletion, all data held in our application — including account identifiers — is permanently destroyed.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Istanbul Courts and Enforcement Offices.

In the event of a dispute, the parties shall first attempt amicable resolution through the in-app communication channel.
